1. About these terms
These terms and conditions ("Terms") govern your use of the Travel Provider Check website at travelprovidercheck.com ("the Service"), operated by Patryk Kuczynski, a sole trader registered in Scotland, United Kingdom ("we", "us", "our").
By using the Service you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. What the Service does
Travel Provider Check helps UK consumers verify travel providers by checking publicly available data sources including ABTA, ABTOT, ATOL, Companies House, Trustpilot, and website analysis. We compile this data into verification reports containing risk signals.
Important:
- Our reports present risk signals from publicly available sources. They do not constitute legal advice, financial advice, or an official verification of any travel provider.
- We do not endorse, recommend, or guarantee any travel provider.
- We do not impersonate any regulatory authority, trade body, or government agency.
- You should always carry out your own independent research before making a booking decision.
We are an independent service and are not affiliated with, endorsed by, or connected to any travel provider, regulatory authority, or trade body mentioned.
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement.
4. Your account
You may create an account using your email address. You are responsible for:
- Keeping your email account secure (we use magic-link authentication — there is no password)
- All activity that occurs through your account
- Providing accurate information
We may suspend or terminate accounts that breach these Terms.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Scrape, crawl, or systematically extract data from the Service by automated means
- Attempt to gain unauthorised access to any part of the Service or its systems
- Introduce viruses, trojans, or other malicious code
- Impersonate any person or entity
- Use the Service to harass, defame, or threaten any person or business
- Commercially resell or redistribute our reports without written permission
Any breach of these rules may also constitute an offence under the Computer Misuse Act 1990.
6. Fees and payment
Basic provider checks are currently offered free of charge. We reserve the right to introduce paid services in future, in which case pricing will be clearly displayed before you commit to any payment.
Charges will appear as "TRAVELPROVIDERCHECK" or "TPC" on your bank statement.
7. Refund policy
Where a paid service is offered:
- Due to the digital nature of our service, refunds are generally not provided once a report has been generated and delivered.
- However, if you experience a technical issue or believe the service was not delivered as described, please contact us and we will review your case and provide a resolution where appropriate.
8. Accuracy and disclaimers
We take reasonable care to retrieve accurate data from public sources. However:
- We cannot guarantee the accuracy, completeness, or timeliness of any data from third-party sources (ABTA, ATOL, Companies House, Trustpilot, etc.).
- Public registers may contain errors or be out of date.
- Website content can change at any time.
- Our AI-assisted analysis provides risk signals, not definitive verdicts.
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of liability
To the fullest extent permitted by law:
- Our total aggregate liability to you for any claim arising out of or in connection with the Service shall not exceed the amount you paid for the specific check or service giving rise to the claim (or, if the service was free, zero).
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of revenue, loss of business, loss of anticipated savings, loss of goodwill, or loss of data.
- We are not liable for any loss arising from your reliance on information in our reports without carrying out independent verification.
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under the Consumer Rights Act 2015 or other applicable UK law
10. Intellectual property
All content, design, text, graphics, logos, and software on the Service are owned by us or our licensors and are protected by UK and international intellectual property laws.
You may download or print individual reports for your own personal, non-commercial use. You may not reproduce, distribute, or commercially exploit any part of the Service without our prior written consent.
11. Third-party links and services
Our reports may contain links to external websites (e.g. Companies House, ABTA, Trustpilot). We have no control over and accept no responsibility for the content, privacy policies, or practices of third-party websites.
12. Affiliate Programme
We operate a referral / affiliate programme. An affiliate (“you” in this section) can earn commission on paid checks made by customers who arrive at the Service via your unique referral link. These terms govern participation.
Eligibility. You must hold an account with us, be at least 18 years old, be legally able to receive payments, and (if UK-resident) either be registered as self-employed with HMRC or accept sole responsibility for reporting earnings under HMRC’s trading and property allowance. We may refuse or revoke participation at our discretion.
How commission is earned. When a new customer first arrives at the Service via your unique link and later pays for a provider check, you earn a percentage commission on the amount actually paid. By default the commission rate is 25% and the attribution window is 12 months from the customer’s first paid check; different rates or windows may be agreed in writing with individual affiliates. Only new customers are attributed; customers who already have an account or prior paid check with us at the time of clicking your link do not qualify.
Ineligible transactions. You do not earn commission on (a) your own checks (self-referral is blocked), (b) checks made entirely free by voucher, (c) voucher-discounted amounts (commission is paid on the amount actually paid), (d) refunded payments (commission is clawed back when we refund the customer), or (e) any transaction we reasonably believe to be fraudulent or abusive.
Payouts. Commissions enter a 14-day holdback period before becoming available. Available balances are paid out monthly once they meet the minimum threshold of £20. Payouts are issued via Stripe Connect to the bank account you connect in your Stripe Express dashboard. Amounts below the minimum roll over to the next month. You are responsible for any bank fees charged by your receiving bank.
Your responsibilities. You must not (a) represent yourself as acting on behalf of us, (b) use misleading, spammy, or paid-search bidding on our brand name, (c) incentivise clicks through unlawful or deceptive means, or (d) promote the Service to prohibited audiences (e.g. under-18s). You are solely responsible for paying any taxes (including UK income tax and National Insurance where applicable) on commissions received.
Termination. Either party may terminate participation at any time. We may suspend or terminate your affiliate account for breach of these terms, suspected fraud, or other misconduct; in such cases outstanding pending commissions may be forfeited. Earned and already-paid-out commissions are not recoverable by us on termination, subject to the refund-clawback rule above.
Changes. Commission rates, the holdback, the attribution window, and the minimum payout may be changed with reasonable notice. Existing attributions at the time of a change remain at the rate that applied when the customer was first attributed to you.
13. Data protection
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. We process personal data in accordance with the UK GDPR and the Data Protection Act 2018.
14. Availability
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or reasons beyond our control. We will not be liable for any loss caused by the Service being temporarily unavailable.
15. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated via a notice on the website. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
16. Termination
You may stop using the Service and delete your account at any time. We may terminate or suspend your access if you breach these Terms, with or without notice. On termination, your right to use the Service ceases immediately. Clauses that by their nature should survive termination (including liability, intellectual property, and governing law) will continue to apply.
17. Governing law and jurisdiction
These Terms are governed by the laws of Scotland.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
Nothing in this clause affects your statutory rights as a consumer under UK law.
18. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding use of the Service. They supersede any prior agreements or understandings.
